Randolph County Man Appears in Court on Second-Degree Murder Charge

ASHEBORO, N.C. – A man from Randolph County made his first court appearance Wednesday after being accused of second-degree murder in connection with a fatal shooting outside a Marshall’s store.

 

 

Authorities say 23-year-old Alexander Benitez-Hernandez lost his life on August 30 following a confrontation that began inside the East Dixie Drive store and later escalated into the parking lot.

 

 

During the hearing, Branson Russell, the man charged in the case, appeared in a wheelchair. According to those present in the courtroom, Russell shook his head while looking at his attorney and law enforcement officers standing nearby. Cameras were not permitted inside.

 

 

Prosecutors outlined their account of the events, stating that both men were armed when the altercation moved outside. Investigators reported that Benitez-Hernandez fired a shot into the ground, striking Russell in the leg. In response, Russell allegedly went back to his vehicle, retrieved a rifle, and shot Benitez-Hernandez in the back.

 

 

Responding officers found Benitez-Hernandez dead at the scene. Russell, who police say fled in his truck at a high rate of speed, was later located and taken into custody.

 

 

Family members of the victim attended the hearing and became emotional as proceedings unfolded. They have asked the community to respect their privacy during this difficult time.


Russell’s defense attorney requested that the judge consider lowering bond due to ongoing medical needs. However, the judge denied the request, keeping Russell in custody. He is expected to return to court on September 15.
