Terms and Conditions for Mugshot Removal Request

Jurisdiction: North Carolina
Please carefully review the following Terms and Conditions before submitting a Mugshot Removal Request (“Request”) to Rowan County Mugshots and its subsidiaries (“we,” “us,” “our,” or “the Website”).
By submitting a request, you agree to these Terms, which are governed by the laws of the State of North Carolina.
1. Eligibility for Removal
Under North Carolina law, most arrest and court records are considered public records (N.C. Gen. Stat. § 132-1), but individuals may request removal under the following circumstances:
Eligible Requests must meet at least one of the following:
• The charges were dismissed or resulted in a “Not Guilty” verdict.
• The arrest or conviction has been expunged under N.C. Gen. Stat. § 15A-145 through § 15A-149.
• A valid court order (e.g., Order for Expunction) has been issued requiring removal.
• The arrest is over 7 years old and is no longer of public interest or relevance. Documentation is required in all cases and may include certified court documents, expunction orders, or government-issued identification.
2. Required Information for Submission
All Mugshot Removal Requests must include the following:
• Full legal name as listed in the arrest.
• Date of arrest and county or municipality in North Carolina where it occurred.
• Case number (if available).
• Legal documentation proving eligibility for removal (e.g., expunction, dismissal order).
We will only review fully completed requests. False or incomplete submissions will be disregarded.
3. Review & Response Time
We aim to review requests within 10 to 14 business days. Submitting a request does not guarantee removal. Each case is evaluated on an individual basis, in accordance with N.C. public records laws and our editorial discretion.
4. No Fees or Third-Party Payments
• We do not charge for the removal of content that meets our eligibility criteria.
• We do not accept payment in exchange for removal.
• We are not affiliated with any third-party services or attorneys claiming to “clean up” online arrest records for a fee. If a third-party claims to guarantee removal from our site, report it to us immediately.
5. Right to Deny Requests
We reserve the right to deny requests that:
• Do not meet our eligibility criteria or legal standards.
• Are unsupported by required documentation.
• Are related to active cases, convictions not eligible for expungement, or matters of ongoing public interest.
• Appear fraudulent or deceptive in nature.
6. Search Engine & Third-Party Indexing
We cannot guarantee that removal of content from our site will remove it from search engines or third-party archives (e.g., Google, Bing, or mugshot aggregator sites). Removal requests must be made to each platform individually.
7. Confidentiality & Use of Submitted Information
• All personal information submitted is used solely for verification and processing your request.
• Documents will not be shared or sold, and are protected under our Privacy Policy.
• We will comply with valid subpoenas or court orders under N.C. Gen. Stat. § 132-1.4.
8. Legal Jurisdiction
These Terms are governed by the laws of the State of North Carolina. Any disputes arising out of these Terms shall be resolved in the appropriate state courts located in North Carolina.
9. Updates to Terms
We reserve the right to amend these Terms at any time without prior notice. Continued use of the Mugshot Removal Form constitutes acceptance of any updates.
